Every employee in the state of New York must be aware of the following basic New York worker rights.
NY Minimum Wage
The NY minimum wage varies based on the size of the company and the location of the workplace. It is a basic New York worker right that every employer in New York State must disclose the type of compensation an employee will get, including whether it will be paid hourly, weekly, monthly, or yearly. Additionally, the employer must specify how many hours the rate applies.
New York City’s current minimum wage is $15 per hour for both large employers and small employers. As of December 31, 2020, the NY minimum wage is $12.50 per hour. New York’s minimum wage for workers under the age of 18 is $7.25 an hour. The type of work employee does, and the county where they work will determine whether they qualify for the minimum wage.
NY OSHA Laws
You have the right to a safe working environment. To avoid work fatalities or significant workplace injuries, the Occupational Safety and Health Act of 1970 (OSH Act) was created. It is a basic New York worker right that employers give their workers safe working environments. A worker will receive compensation if they suffer an injury at work or become sick from something linked to their employment.
OSHA is one of the NY employment laws that impose protective workplace safety and health regulations. Additionally, it offers assistance, training, and information to both employees and employers. If employees think their employer is not following OSHA laws, they can file a complaint so that OSHA can inspect their workplace. Employees can also do so if they think there are significant risks at work.
NY One Day Rest in Seven Law
The One Day Rest in Seven law is a basic New York worker right that employers must provide workers with at least 24 hours (one day) of rest every workweek. This law applies to employers such as hotels, restaurants, factories, and mercantile establishments. However, section 161 of the New York Labor Law also mentions other employers in specific circumstances and covers them as well.
